AssistIQ Privacy Policy

AssistIQ provides healthcare providers with a platform to optimize supply chain management and inventory processes in the operating room and procedural areas (the “Services”). This Privacy Policy (“Policy”) describes how AssistIQ may collect, use and disclose personal information about visitors of its website at https://www.assistiq.ai/ (the “Website”) and users of AIQ Capture (the “App”). This Policy also describes how we protect your personal information and the rights you have regarding your personal information under applicable privacy and data protection laws.

  1. Collection and Use of Personal Information

AssistIQ has designed the App to avoid any collection of users’ personal information. The App is available on customer-managed iPads physically secured in a floor stand in operating rooms or procedural areas in the customer’s facilities. The use of the App on these devices does not require a user login or other form of user identification. The App collects information that users input into the App, namely photos of product packages taken using the device’s camera (and related data such as the time stamp of each photo) and feedback submitted through the App (“App Data”). App Data is linked to the device on which the App is installed (and the specific area of the customer’s facility where the device is located), but it is not linked to a particular user. Should App Data incidentally include personal information, we will process such information in accordance with this Policy and applicable privacy and data protection laws.

We may collect personal information in the following circumstances:

  • If you are an App user and you communicate with AssistIQ to obtain assistance regarding the App (for example, using the App’s “Help” function), we will collect information necessary to provide required assistance. This may include your name and contact information, the name of the relevant AssistIQ customer (i.e., the organization in which you use the App) and information about the issue you encounter with the App. We use this information to respond to your request for assistance.
  • If you contact us using the form available on the Website or by email, including to schedule a demo, we collect the information you choose to provide, such as your name, email, company name, and any additional information you provide in the form’s message field or in your email. We use this information to respond to your request, for example, to provide you information about our Services.

In addition to the purposes described above, we may also use your information for the following purposes:

  • To comply with applicable laws and to exercise our legal rights.
  • For other purposes for which we provide specific notice at the time of collection and obtain your consent to the extent required by applicable law. 
  • We may aggregate or anonymize any information collected about you so that it no longer allows us to identify you directly or indirectly. We do this as to protect your privacy and the security of your information, and we may use and share that aggregated or de-identified information for any purpose, for example, to conduct research and analytics, improve our products, services and the user experience, and develop new offerings. When we maintain and use de-identified data, we will not attempt to re-identify the data unless expressly permitted or required by law.
  1. Disclosure of Personal Information

We may disclose personal information as follows:

  • Customers: AssistIQ processes App Data on behalf of its customers. Therefore, our customers have access to such data. To the extent App Data incidentally includes personal information, our customers will have access to such personal information.
  • Service providers: We may engage third-party service providers to assist us with operating our business and providing our Services to our customers. For example, these service providers may provide technology support for our Website and App. We and our service providers may access, store and otherwise process personal information outside of Canada (and, for residents of Quebec, outside of Quebec), where we or our service providers are located. As a result, when your personal information is used or stored in a jurisdiction other than where you are residing, it may be subject to the law of this foreign jurisdiction, including any law permitting or requiring disclosure of the information to the government, government agencies, courts and law enforcement in that jurisdiction.
  • As otherwise permitted by law: We may disclose your personal information to law enforcement agencies, courts, other government authorities or other third parties where we believe it is necessary to comply with a legal obligation. We may disclose personal information as we deem reasonably necessary to support lawful investigations or otherwise to protect our rights or the rights of you or any other party.
  • In the context of a transaction: We may disclose your personal information to potential transaction partners, service providers, advisors, and other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company, or in which we sell or transfer all or a portion of our assets or business.
  1. Retention of Personal Information

We will keep your personal information until we no longer need it to fulfil the purposes for which it was collected. However, we may retain your personal information for a longer period when required to comply with our legal and regulatory obligations regarding information or record retention.

We use cookies and similar technologies to ensure the functionality and security of our Website. 

Your browser may tell you how to restrict or disable certain types of cookies. Note, however, that without cookies, you may not be able to use all of the features of our Website. For mobile devices, you can manage how your device and browser share certain device data by adjusting the privacy and security settings on your mobile device.

  • Internal policies and procedures that define the roles and responsibilities of our employees, representatives, and service providers throughout the life cycle of personal information and limit their access to that information on a “need-to-know” basis.
  • Physical, electronic and procedural safeguards that comply with relevant standards to protect personal information.
  • If the information is collected or stored electronically, technical safeguards such as encryption, firewalls, passwords, anti-virus software and similar measures.
  • A designated privacy officer to monitor our compliance with applicable privacy and data protection laws.
  • Procedures for receiving, investigating, and responding to complaints or inquiries about our information handling practices. 
  • Contractual protections to ensure that service providers with whom we share personal information maintain adequate protections and security standards.

Depending on where you reside, you may have the following rights with respect to your personal information, subject to limited exceptions set out in such laws:

  • Right to information. You have the right to ask us about our processing of your personal information, including about the categories of persons who have access to your personal information within our organization and the applicable retention period.
  • Right to access. You can ask us if we hold any personal information about you, and if so, you can request access to that personal information.
  • Right to correction. You have the right to ask us to rectify any personal information that you demonstrate to be incorrect or outdated and to complete any information that you demonstrate to be incomplete.
  • Right to withdraw consent. You may withdraw your consent to our processing of your personal information to the extent permitted by law and our contractual obligations.
